What Is The Difference Between And Chapter 7 And A Chapter 13

Consumers normally file under one of two chapters of the United States Bankruptcy Code- Chapter 7 or Chapter 13.

Chapter 7 Bankruptcy is called liquidation. If the debtor qualifies, unsecured creditors, like credit cards, medical bills and others can be discharged. Under West Virginia law, a debtor can exempt many of their household items, along with some equity in their homes and cars, which can allow them to retain an approved amount of assets under West Virginia Law.

Chapter 13, unlike Chapter 7, allows the debtor to reorganize their debts under the supervision of the Bankruptcy Court with a repayment plan suited to their individual needs. It is important that you discuss your options with a Bankruptcy Attorney to see if filing Bankruptcy is the best option for you and whether you qualify to file under Chapter 7 or Chapter 13.

Credit Counseling

We can all benefit from credit counseling and prior to filing a Bankruptcy Petition in the Norther District of West Virginia a debtor is required, under the Bankruptcy law, to participate in credit counseling. This can be done over the phone or the internet. Most credit counseling agencies charge Fifty-dollars ($50.00) or less for this service. A credit counseling session usually takes about 90 minutes of your time.
